11-year-old girl interrupts pregnancy in SC after MPF recommendation

The Federal Public Ministry (MPF) confirmed, this Thursday (23), the termination of the pregnancy of a minor under 11 years of age, a rape victim in Santa Catarina. According to a spokesperson for the Public Ministry, the procedure was carried out on Wednesday (22) at night.

“The hospital informed the MPF, within the established deadline, that the patient and her legal representative were contacted and adopted measures to terminate the child’s pregnancy”, informs, in a note, the University Hospital (HU) Polydoro Ernani de São Thiago, from the Federal University of Santa Catarina (UFSC)”, says the note.

The Public Prosecutor’s Office also says it regrets “the sad situation that has occurred”. The case gained repercussion after a hospital in Santa Catarina initially rejected abortion – provided for by law in cases of sexual violence and risk to maternal life – because the pregnancy had exceeded the limit of weeks allowed by internal rules.

When the case came to court, magistrate Joana Ribeiro Zimmer ordered the girl to be taken to a shelter, using as a justification in one of the orders the “risk” of the mother performing “some procedure to operate the baby’s death”.

Although Zimmer cited the “risk of the baby’s death” to justify the victim’s going to a shelter, the Public Ministry of Santa Catarina (MPSC) states that the request for provisional shelter was made “with the sole objective” of putting the child at risk. child safe from possible further abuse.

O Public Ministry of Santa Catarina (MPSC) in a clarification note, stated that as soon as the Guardianship Council learned of the situation, “immediately” the child was referred to the Professor Polydoro Ernani de São Thiago University Hospital, linked to UFSC, “for the abortion”.
