99 goes against city halls and launches motorcycle taxis in São Paulo and Rio next Tuesday

Starting next Tuesday (31), the 99 app will offer 99Moto, the company’s motorcycle taxi service, in the Greater São Paulo region and in the city of Rio de Janeiro.

The activity of transporting passengers by motorcycle is not regulated in both capitals.

Recently, the two city halls vetoed the modality when it was offered by Uber. The service already operates in more than 3,000 municipalities and is used by 1.3 million people, according to 99.

In a note, the company argues that the service makes it possible to move to peripheral neighborhoods more quickly and is economically advantageous. On the networks, they say that the races can cost R$ 4.99.

The City Hall of São Paulo took a position against the activity and informed that the Municipal Committee for Road Use (CMUV) had already notified 99 about the suspension of trips made by motorcycles, and states that any company that offers the service in the capital will be subject to sanctions administrative penalties, fines and even losing the license to operate in the city.

On the 7th, Mayor Ricardo Nunes published a decree suspending this type of transport in the city. As the service is not regulated, the City Hall formed a Working Group to discuss how the activity can be offered legally and with the greatest security.

Experts heard by Estadão they criticize mototaxi and similar activities because they can increase the number of accidents and victims in traffic. Especially in a city where the number of accidents is already high.

According to data from the São Paulo Traffic Accident Management Information System (Infosiga), released last week, 859 people died in the city of São Paulo while in traffic. The average is one death per motorcyclist per day in the city.

Federal

99, on the other hand, states that the activity has legal support based on Federal Law 13,640, which allows private individual transport by applications, but without specifying the modal. The loophole in the legislation was the same argument used by Uber when, at the beginning of the year, it started offering the service in São Paulo.

In addition, 99 says in an official note that the regulation of transport is not up to the municipalities, but to the Union, which would prevent city halls from prohibiting the activity. The City Hall of Rio de Janeiro was contacted for comment on the matter, but did not comment until 8 pm this Friday (27).
