99 stated that the stance of São Paulo city hall in the controversy over the motorcycle taxi service “characterizes a persecution of the application”. The positioning was sent to CNN this Wednesday (22), after Mayor Ricardo Nunes (MDB) stated that he will file a criminal complaint against the company.

According to the company, the mayor’s actions attempt to “criminalize the discussion about a service that already benefits people in more than 200 thousand races in the city”.

The note from 99 states that the persecution is not only against the company but also “its employees and service users: passengers and partner motorcyclists”.

“No crime was committed and there is no disrespect for any judicial decision”, he says. “Any prohibition or restriction on activity is unconstitutional”, states the company when recalling decisions from the São Paulo Court of Justice (TJ-SP) and the Federal Supreme Court (STF).

This Wednesday morning, Mayor Ricardo Nunes said he was “outraged” by the company’s insistence on offering the service in the capital. “I am outraged to see a company of this size, only aiming for profit, this greed for profit. Disregarding the risk to people’s lives,” he said.

The mayor highlighted the increase in the number of deaths in motorcycle accidents in São Paulo, which rose from 403, in 2023, to 483 last year. “We have presented data and said that this activity will increase the number of deaths and yet they insist on carrying out this activity”, he stated.

Also according to Nunes, after the ten-day deadline for 99 to present appeals, the city hall will impose a fine of R$50,000 per day.

The city hall, through the Municipal Attorney General’s Office, informed the CNN that it had not yet been notified of the decision and that it would analyze the appropriate appeal.
