The return of 270,400 euros to Ellactor by the former CEO and former major shareholder of the company, Anastasios Kallitsantsi and the company Nexus Design Studio was upheld by the Athens Multi-Member Court of First Instance. At the same time, it obliges Mr. Kallitsantsis to pay Ellactor the amount of 430,000 euros.
This decision concerns a lawsuit filed by Ellactor against Mr. Kallitsantsis and the company Nexus Design for an invoice of 260,400 euros with VAT paid by the construction group to the consulting company on 25-11-2020, for the provision of consulting services regarding the urban and spatial planning legislation.
In its lawsuit, Ellactor complained that these services had never been provided and that this payment was made without a decision of the company’s board of directors, which was necessary, as the legal representative of Nexus Design is the wife of the then CEO of its subsidiary, REDS.
The court partially accepted the lawsuit and decided to return the total amount paid to Nexus Studio together with the legal interest and even awarded Mr. Kallitsantsis the payment of 430,000 euros which is equal to his annual gross salary, as it is activated. criminal clause provided for in the contract of the former managing director with the company.
The court also sentenced the two defendants to part of Ellactor’s court costs, which was set at 10,450 euros, and Mr. Kallitsantsis to Ellactor’s court costs of 15,700 euros.
