Judge of the Supreme Court of Brazil annuls criminal sentences of left-wing former president Luis Inacio Lula da Silva, a decision that allows him to run in next year’s presidential election.
In a surprise decision, Judge Enson Fahin stressed that a court in the southern city of Curitiba had no jurisdiction to try Lula on corruption charges, stressing that he should be tried again in federal courts in the capital, Brasilia.
The decision, which will be reviewed by the plenary of the Supreme Court, restores Lula’s political rights, paving the way for his presidential candidacy in the 2022 elections, with far-right president Zaich Bolsonaro rival expected to run for re-election.
A spokesman for Brazil’s attorney general said Augusto Aras would appeal Fahin’s decision.
Lula ruled Brazil between 2003 and 2011. He was jailed after being convicted of corruption in 2018, which prevented him from running in that year’s presidential election.
He was released at the end of 2019, but could not claim the office because of his criminal record.
