Three advisors to federal deputy Daniel Silveira (PTB-RJ) will be heard this Tuesday (14), by the Federal Court, in Rio de Janeiro, accused of handing two cell phones to the parliamentarian while he was in PF custody.
At the hearing scheduled for 2 pm, at the 1st Federal Criminal Court, Silveira’s advisors will have to express their views on the MPF/RJ’s proposal for the payment of a fine of R$ 10,000, for the alleged crime committed.
In April of this year, the Federal Public Ministry filed a complaint against the congressman’s three advisors and proposed the immediate application of the sentence. If they do not comply with the agreement, the penalty provided for the crime committed is imprisonment, from three months to one year.
In addition to the complaint, the MPF also forwarded to the Federal Supreme Court (STF) news of an alleged disciplinary infraction against the deputy who, according to the investigation, would have committed a serious disciplinary offense, as a defendant in the criminal action within the competence of Minister Alexandre de Moraes. .
“The Federal Public Ministry is convinced that there is sufficient evidence for conviction. But, as required by law, we proposed a criminal transaction. With the hearing designated by the Federal Judge, it is up to us to wait for the position of the defendants to continue the criminal prosecution or not”, points out the Federal Prosecutor Eduardo Benones, coordinator of the External Control Center for Police Activity, responsible for the complaint.
During the arrest of deputy Daniel Silveira, in February 2021, one of his advisors would have promoted the delivery of a cell phone to the parliamentarian, being assisted by another advisor. According to the complaint, a third advisor promoted the delivery of another device to the custodian.
The discovery of the cell phones occurred after a search was carried out in the deputy’s accommodation, at the Federal Police Superintendence, in Rio, when police located the two devices hidden inside a suitcase with the deputy’s clothes. The equipment was blocked and placed in airplane mode, being later handed over to the delegate on duty.
