After 150 days without denunciation, justice releases accused for quilombola homicide

The Second Panel of the Second Criminal Chamber of the Bahia Court of Justice (TJ-BA) granted habeas corpus to Uillian Portugal Brito arrested preventively on suspicion of qualified homicide by Quilombola leader Flávio Gabriel Pacifico dos Santos, Binho do Quilombo, in 2017.

The decision was made after the defense claims to be excessive deadline in custody, as even after more than 150 days of his arrest, the prosecutor did not offer a complaint against Brito.

Habeas Corpus was filed by lawyer Reinaldo da Cruz de Santana Júnior, who argued illegal embarrassment due to the delay in investigation and the absence of sufficient evidence for the formalization of the prosecution.

The Public Prosecution Service, in turn, requested the return of the case to the police station for new steps, recognizing that there are still no concrete elements that bind the investigated to the crime .

The Court understood that the maintenance of prison without a defined deadline for the completion of investigations hurts fundamental guarantees.

“The patient cannot continue with his freedom curtailed indefinitely while seeking some minimal evidence of authorship,” said the rapporteur of the decision.

THE CNN contacted the Public Prosecution Service of Bahia in order to question the non -offer of complaint. The space is still open.

Precautionary measures

Despite granted habeas corpus, a series of alternative precautionary measures should be fulfilled by the accused, such as monthly criminal court appearance, prohibition to attend bars and restaurants, night home collection and use of electronic anklet.

Remember the case

The Federal Police (PF) had arrested in July 2024 the man suspected of murdering the leader “Binho do Quilombo” in 2017. He is the son of Bernadete Pacific, known as “Mother Bernadete”, which was also executed in August of the year past.

The work of the PF was done at the time through the operation called Palmares, with the aim of investigating the authorship of the murder and arresting another person.

Binho do Quilombo was a representative of the quilombola community of Pitanga dos Palmares in Simões Filho, Bahia, along with his mother, Maria Bernadete Pacific Moreira. She was also a victim of murder in August 2023.

Investigations on Binho’s homicide began at the Federal Police in September 2017. The crime was committed on September 19 of that same year.

According to the PF, the elements of the investigation demonstrate that the suspects used a vehicle fraudulently acquired on behalf of a third party, funded by using counterfeit documents.

The PF also found that the mobile number used by one of those investigated at the time of the crime was registered in the name of this same person of the false documentation.
