After capture in the USA, the Tocantins court resumes the case of Danilo Cavalcante

The Tocantins Court of Justice (TJ-TO) will resume, on October 11th, the trial of the case of Brazilian Danilo Cavalcante. On this date, the TJ scheduled the accused’s pre-trial hearing.

Danilo became known for escaping from a prison where he was held in the United States, after being sentenced to life in prison for the murder of his ex-girlfriend Débora Brandão, in 2021.

He was captured on Wednesday (13), around 9 am, Brasília time, by the Pennsylvania state police, after two weeks on the run.

In the case being processed in Brazil, he is accused of having killed Válter Júnior Moreira dos Reis on November 5, 2017, in Figueirópolis, south of Tocantins. It is this second crime that Justice will focus on.

He was accused of, on that occasion, having shot Válter with a firearm when they were at a food stall.

According to the TJ of Tocantins, the hearing had not been held previously because the “Judicial Power of Tocantins was in negotiations with the North American embassy to hear the accused via video conference in the penitentiary where he was imprisoned”.

“With the escape, the accused was declared in default (not following the established order) and, as provided for in the Code of Criminal Procedure, the session can be held without his presence”, explained the court.

A public prosecutor, a public defender, who will represent Danilo, will participate in the hearing, which will be open to the public, in addition to seven witnesses being heard, all for the prosecution.

According to the complaint, Cavalcante committed the crime “voluntarily, acting with the will and determination to kill”, using a firearm.

According to the complaint, Cavalcante had “committed the crime consciously and voluntarily, acting with the desire and determination to kill, for a base reason and through a resource that made it difficult for the victim to defend himself, using a firearm”.

Denise Moreira dos Reis, sister of the young man murdered in 2017, reports that the crime happened as a result of a car accident in which the two were involved. “My brother crashed his car, he owed it a repair and he was killed because of it,” she told CNN .

Denise considers the reason to be “nonsense” that could have been avoided, since her father and her own brother worked and were able to bear the loss of the crash. “My brother said he was going to pay the debt, but Danilo couldn’t wait”, recalls Denise.

On November 13, 2017, the Court ordered the preventive detention of Danilo Cavalcante. However, he had already fled the state.

Cavalcante would have fled first to Puerto Rico and then to the United States.

“As soon as the Judiciary learned that the accused was in prison, serving a sentence in the United States, it began negotiations with the North American embassy in order to proceed with the process,” said the TJ-TO.
