AGU asks STF to postpone hearing to discuss ownership of Fernando de Noronha

The Attorney General’s Office (AGU) asked the Federal Supreme Court (STF) to postpone the in-person conciliation hearing scheduled for the 27th in an action in which the Union asks for federal ownership over the Fernando de Noronha Archipelago to be recognized.

“The Union informs the Court that the necessary steps are still in progress to verify whether it is possible to reach the consent of Organs federal bodies involved in the dispute regarding the feasibility of conciliation. In this step, it believes that the postponement of the conciliation hearing scheduled for 06/27/2022 is healthy, since the competent federal technical bodies have not yet issued a formal position on the very feasibility of a negotiated resolution of the dispute “, said the AGU.

According to the AGU, given the lack of a formal position from the federal technical bodies regarding the possibility of negotiation in the specific case, the meeting “tends to be fruitless”.

The AGU also said that, if the postponement is deemed unfeasible, that the Federal Court of Auditors and the Federal Public Ministry be summoned to appear at the hearing.

“Before the technical bodies complete their analysis of the feasibility of conciliation itself, the Union will not be able to present any proposal for an agreement in court, nor will it be able to agree with any proposals that are offered to it”, he said.

Last week, Minister Ricardo Lewandowski, of the STF, confirmed a new conciliation hearing for June 27.

In March, the federal government filed a lawsuit in the STF asking for the federalization of the territory of Fernando de Noronha, which today belongs to the state of Pernambuco.

On May 27, in the first hearing, the parties only started negotiations for a consensual solution to the conflict.

In the lawsuit pending, the government alleges that Pernambuco “has been failing to comply with the terms of the contract and hindering the work of the Secretariat for the Coordination and Governance of Union Heritage and federal environmental agencies in the management of the area”.
