The Amazonas Justice legally recognized a case of socio -affective aviation at the request of the Amazonas Prosecutor’s Office (MPAM). The decision was commanded by the 7th Family Court with the 37th State Prosecutor’s Office, establishing the legal recognition of the bond between grandparents and grandchildren without biological relationship.
According to the MP, the recognition of the socio -affective relationship of this case, between grandparents and grandson, includes sharing the child custody with biological parents.
Becoming an innovative case in the state of Amazonas because it expands the concept of forms of kinship since recognition of socio affectivity as a foundation for affiliation relations beyond the biological bond is already recognized in Brazilian law.
For the prosecutor of the case, Luciana Toledo Martinho, “the demonstration was based on the principles of family law, such as affectivity, family life, family function and solidarity, legal and constitutional provisions and recent judgments of Brazilian courts on the subject”.
