The independent committee in charge of investigating Americanas’ accounting inconsistencies does not have a deadline to present a report, said this Wednesday (1st) the lawyer Otávio Yazbek.
“It’s a super complex case, which is made more complex by the litigation environment that exists,” Yazbek told reporters after participating on a panel during Credit Suisse’s annual event with investors.
Yazbek, along with Vanessa Claro Lopes and Pedro Melo, make up the committee hired by Americanas to investigate the accounting and governance failures that allowed a BRL 20 billion shortfall that led the retailer to bankruptcy protection last month.
The lawyer said that the committee hired the law firm Maeda, Ayres & Sarubbi, specializing in compliance and investigations, to help with the work.
According to Yazbek, a report will first be presented to Americanas, but may be shared with regulatory authorities, if the company authorizes it.
The lawyer, former director of the CVM, refuted accusations that he would not have the necessary exemption for the job, since he already had Americanas as a client.
After the constitution of the committee, Bradesco, which is one of Americanas’ biggest creditors, stated that the committee had no exemption to handle the case, since at least two of the three members of the body “have an interest, to a greater or lesser extent , with the outcome of the investigation”.
Without naming names, Yazbek stated that this position is “more linked to a bellicose posture” by the institution that is the creditor of Americanas.
