Animal lawsuit: Cat files legal action against clinic in RS

A cat named Cacau was accepted as the author of a lawsuit against a veterinary clinic because of alleged mistreatment suffered during a surgical procedure carried out at the establishment, located in Rio Grande do Sul.

This is the first time in history that an authorization like this has taken place in the district of Santa Maria, according to the RS Court of Justice.

Due to the cat’s health status after castration, the owner, together with Cacau, filed a lawsuit for “moral and material damages” against the clinic, alleging that the cat had suffered several complications due to the procedure. carried out.

Since the surgery, in addition to the problems he faced, Cacau also developed chronic kidney failure.

The story

Cacau underwent castration surgery in May last year. Post-operatively, the owner reported to the clinic that the cat was not eating or drinking, in addition to being weak and with dilated pupils. In response, the establishment claimed that this type of behavior was “normal” after the procedure.

In the following days, the condition worsened, which led the owner to take the cat to another clinic. There, they found that Cacau had an infection at the surgery site, with the tissues already rotted and with all blood levels altered.

According to lawyer Edenise Andrade da Silva, responsible for the action, Cacau had chronic kidney failure, possibly due to the lack of anesthesia to control the signs during surgery. According to her, there is also evidence that tissue contamination occurred during castration.

Today, she undergoes weekly therapies, takes medication and needs special food.

Judge Regis Adil Bertolini, from the 2nd Civil Court of Santa Maria, stated in the process that, in the specific case, the damage compensation action deals with “alleged mistreatment experienced by the non-human author undergoing a surgical procedure, represented by her guardian ”, and that, therefore, “it appears to be appropriate to recognize the active legitimacy of the non-human co-author”.

“Although the recognition of the ability to be part of domestic animals is a controversial topic, the jurisprudence of Brazilian Courts is increasingly moving towards recognizing the possibility of domestic animals being perpetrators in legal proceedings, especially in actions that deal with the respect, dignity and rights of these beings”, stated the judge.
