This Wednesday (24), a judge annulled six articles of the decree of necessity and urgency (DNU) that the president of Argentina, Javier Milei, issued in December, days after taking power. The annulled articles deal with issues such as union contributions and collective bargaining, the decision indicates.
Labor judge Liliana Rodríguez Fernández issued her decision in response to an injunction promoted by the General Confederation of Labor of the Argentine Republic (CGT), which considers that several points of the DNU affect labor and union rights.
In her decision, the judge agrees with the CGT in concluding that – in her opinion – there is no justification for the Executive Branch to resort to an extraordinary instrument to change these rules without first going through the Legislative Branch.
However, it also clarifies that the articles will remain in force if the DNU is ratified by legislators.
“(It is resolved) to declare the nullity of articles 73, 79, 86, 87, 88 and 97 of DNU 70/2024 within the scope of this support process and the current factual circumstances, without prejudice to clarifying that it will be valid in the case of ratification by both Chambers within the period of the current extraordinary sessions, under penalty of its validity being terminated in its own right”, states the judge in her decision.
In this sense, it urges legislators to comment on the DNU, whose legality has been questioned by some political sectors since it was published by Milei.
“There is no legal possibility of remaining silent: both Chambers must speak out, accepting or rejecting”, says the decision.
The decision against these DNU articles was announced on the same day that Milei's government faces its first general strike, with protests in Buenos Aires and other cities, just a month and a half after taking office, on December 10.
CNN contacted the Milei government's press office to ask for a position on the matter and is awaiting comments.
