Argentine court indicts Brazilian doctor in case of model who fell from the 6th floor

Brazilian doctor Juliana Magalhães Mourão, who until then was considered a witness in the case of the death of Bahian model Emmily Rodrigues, was indicted last Monday (25) on suspicion of abandonment of a person.

The hypothesis arose after investigations indicated that Juliana, despite having been able to ask for help, did not do so immediately during the incident that resulted in Emmily falling from the sixth floor of a building in the Retiro neighborhood, in Buenos Aires, on the 30th of March 2023.

The indictment request was made by the National Criminal and Correctional Prosecutor’s Office No. 10 of the Federal Capital of Argentina and by the Specialized Prosecutor’s Office for Violence against Women (UFEM), requested by judge Luis Schelgel. Juliana will be interrogated on December 4th.

In addition to her, Argentine businessman Francisco Sáenz Valiente, already investigated, had his charges expanded. Now, he is responsible for the crimes of supplying narcotics, providing a place for consumption, abandonment of a person, aggravated by death and illegal possession of a weapon of war.

According to the Public Fiscal Ministry (MPF), which is equivalent to the Federal Public Ministry in Brazil, during the hearing on Monday (25), Sáenz Valiente refused to testify. At the time, he was represented by deputy attorney Juan José Taboada Areu.

Investigations indicate that Emmily Rodrigues was in Francisco Sáenz Valiente’s apartment, and a toxicological examination revealed that she had consumed several substances, such as alcohol, marijuana, MDMA, ketamine and cocaine.

Initially, the businessman was accused of feminicide and remained in preventive detention for three weeks, in April 2023.

However, in June, the Prosecutor’s Office changed the charge to manslaughter (without intent to kill), also including the supply of narcotics and the provision of a place for consumption.

Investigations indicate that the drugs supplied by the businessman led Emmily to decompensate, which could have been avoided if help had been requested in time.

“Both allowed the situation to continue without providing the assistance the victim needed and only tried to ask for help when it was too late”, indicated the MPF representatives in the decision.

Prosecutors noted that, despite evidence that Emmily’s behavior was a risk to herself and others, for more than two hours they maintained “control of what was happening in the apartment and continued with the meeting, instead of taking care of the victim’s health.” ”, points out the MPF.

The call would only have been made when the young woman “was already in a state of euphoric despair, terror and crying and was screaming for help”.
