An army doctor lost his post from the corporation’s captain after being convicted of an alleged condemnation of an examination that would be intended to exempt her mother of income tax payment.
The decision was taken unanimously after judgment at the Superior Military Court (STM). The cassation process began in May 2023 and was initiated by the corporation command.
According to the lawsuit, the military used “its position as an expert to improperly benefit its mother, performing an expert examination and issuing a doctor’s opinion favorable to the granting of income tax exemption, in disagreement with previous technical reports.”
The officer was denounced by the Military Public Prosecution Service for the crime of estelionato. In addition to the loss of the post and patent, she was sentenced to 11 months and 18 days of detention.
According to the court, the defense of the doctor claimed that the official “acted in accordance with his medical convictions and that he would have received verbal authorization to act in the case” and that there was no intention or prejudice to the corporation.
