The Flamengo fan accused of throwing a glass bottle and causing the death of Gabriela Anelli, 23, from Palmeiras, in July last year, continues to receive a salary from Rio de Janeiro City Hall.
Jonathan Messias Santos da Silva was arrested in August and since then has received almost R$24,000 net, even though he was not performing his duties.
The civil servant has been on the city council since 2019. He is competitive for the position of elementary school teacher but worked as director of the Escola Municipal Almirante Saldanha da Gama, in Campo Grande, in the west zone of the capital of Rio de Janeiro.
According to the Rio City Hall Transparency Portal, Jonathan's gross salary is R$6,018.55. However, since his arrest, an amount of around R$2,000 per incarceration began to be deducted from his payroll and he began to be assigned to the Department of Finance and Planning, to which the Human Resources sector belongs.
The deduction of one third of the salary is provided for in the City Hall Servant Statute for cases of arrest, until the Court decides whether the accused is guilty or not. If convicted, the server is exonerated.

In a statement, the Municipal Department of Education reported that, at the time of Jonathan's arrest, his salary was suspended. “In fact, the secretary of education, Renan Ferreirinha, has already spoken out against receiving salaries for imprisoned civil servants,” said an excerpt from the demonstration.
The payrolls published on the Transparency Portal also show that, in October, three months after his arrest, Jonathan pocketed a bonus of R$7,021.01 for a “performance bonus”.
A CNN asked the Secretariat about the reason for the benefit, which informed that it refers to the results agreement for the period worked in 2022, the year in which the employee worked normally.

The Flamengo fan's defense told CNN that, since the case is still being judged, Jonathan has the right to receive his salary normally. Lawyer Carolina Dias also informed that a habeas corpus is underway at the Superior Court of Justice (STJ) so that the civil servant can respond freely and denies that the client has any participation in the case.
According to the lawyer, the defense hired a private expert that would have found it impossible to prove that the bottle that hit the victim had been thrown by Jonathan.
Remember the case
In August last year, the Court of Justice of the State of São Paulo (TJ-SP) accepted the complaint from the Public Prosecutor's Office and made the Flamengo player suspected of killing Palmeiras fan Gabriela Anelli the previous month, following a disturbance in the surrounding area, a defendant. of Allianz Parque, in the capital of São Paulo.
In the decision, judge Marcela Raia Sant'Anna also ordered that Jonathan's arrest be converted from temporary to preventive.
On July 8, Gabriela was hit in the neck with a bottle during a disturbance at Allianz Parque, where a match between Palmeiras and Flamengo, for the Brazilian Championship, was taking place.
According to the Military Police, the riot began when two Flamengo fans entered one of the streets that gives access to gate A of the Palmeiras stadium, which generated dissatisfaction among Alviverde fans who were watching the game in commercial establishments outside Allianz Parque.
In addition to Gabriela, another fan was also injured. In serious condition, the young woman was taken to Santa Casa de São Paulo but died two days later.
According to the São Paulo Public Security Secretariat, the suspect was identified using facial recognition cameras and was charged with intentional homicide for futile reasons.
The case gained national attention. Corinthians, Palmeiras, São Paulo and Santos posted notes on their social networks showing solidarity with the fan's family.
