Arthur Hayes prepares to surrender to the US authorities

Former CEO of BitMEX crypto derivatives exchange Arthur Hayes may surrender to US authorities next month. The Block writes about this with reference to a statement by the prosecution made in a New York court during a February hearing.

Hayes is “currently residing overseas in Singapore,” according to the documents, and is in talks with US authorities to surrender, stand trial and respond to a suit filed by the Justice Department last November. Hayes and the other BitMEX founders are accused of violating bank secrecy laws.

 

“With regard to Defendant Hayes, we discussed the due date April 6, 2021 in Hawaii,” Assistant Attorney Jessica Greenwood said during a February 9 hearing. “We intend to notify the court in advance of this appearance and discuss the logistics of its extradition and presentation in court, so that it appears remotely before your honor.”

 

When asked if Hayes would come to New York, Greenwood said:

 

“The idea is for him to first appear in Hawaii, then appear before your honor remotely, and then continue to reside abroad and visit the United States as needed. Of course, if there is a trial, he will appear in the US for this trial in New York. ”

 

She also noted that the conditions for keeping Hayes at large on bail are being discussed and subject to approval in court. During the same hearing, it was announced that the US authorities had begun extradition proceedings for Greg Dwyer, another defendant in the BitMEX case. Greenwood expects these actions to be unopposed, but they were unable to negotiate a voluntary surrender with Dwyer. Co-founder Ben Deal is also poised to appear in New York.

 

“We are working with the FBI and Border Patrol to get an entry permit,” she said. – There are certain difficulties due to the ban on entry from the UK. We expect the necessary permits to be obtained within 30 days. ”
