Assisted suicide, ok to the drug for Mario, Cappato: “Now he is free to choose”

Last November, the Commission assessed the request of Mario, a quadriplegic following a road accident and found the presence of four conditions established by the Constitutional Court in the Cappato / Dj Fabo judgment to access assisted suicide. The following: Mario is kept alive by life-sustaining treatments; he is suffering from an irreversible pathology, a source of physical or psychological suffering that he considers intolerable; he is fully capable of making free and informed decisions; it is not his intention to use other health treatments for pain and deep sedation.

Why is this ok to the drug so important?
«First of all for Mario who can decide, if, how and when to make use of this medical aid for voluntary death. Finally the choice will be his and he is no longer trapped by the ferocity of a bureaucracy that condemns him to continue torture in unbearable conditions of suffering. But this will be true for anyone else who finds himself in the same condition as him because it is the first time that the Italian state recognizes the validity of a medical and pharmacological procedure to help put an end to a person’s life “.

What does this mean for future cases?
“This means that those who one day find themselves in the same conditions and make the same request will no longer expect eighteen months, of which the last three only on this drug decision. At this point, the various procedures and steps have already been clarified by the jurisprudence and the health system and therefore this type of delays can no longer be produced “.

An important turning point a few days after the decision on the referendums.
«The Constitutional Court will meet on Tuesday and it is the most important institutional appointment in my opinion of all these months. In the newspapers we have seen that the rumors are those of an overall rejection of these referendums, in particular the one on euthanasia, cannabis, justice. What is at stake on Tuesday are not only these issues but it is precisely the possibility of the democracy of participation “.

What if there was a rejection?
“If, in the moment in which the parties, the leaders, seem to represent less and less Italian society and to be increasingly powerless in addressing the great issues of our time, the possibility for citizens to take direct action through referendums were canceled, I believe that the repercussions on the institutional system would be terrible. After that, the Constitution excludes the possibility of holding a referendum in three very specific subjects: fiscal and budget laws, amnesty and pardon laws, laws of ratification of international treaties. It is evident that none of these 8 referendums, least of all the one on euthanasia, falls within one of these criteria “.
