Baronovsky: Does the STF decision respect the principle of precaution and reciprocity?

In Freedom of Opinion this Monday (13), Ricardo Baronovsky analyzed the recent decisions of the Supreme Court (STF) on the vaccine passport.

Minister Rosa Weber scheduled for this Wednesday (15th) an extraordinary virtual session of the full Court to judge the obligation of proof of vaccination against Covid-19.

Weber’s decision welcomes the request of the case’s rapporteur, Luís Roberto Barroso, who expressed the wish that the plenary would evaluate its decision on the requirement that travelers arriving in Brazil must present proof of vaccination. Expectations are that other ministers will support Barroso’s deliberation.

Baronovsky believes that certain issues cannot be politicized, as they are technical facts. “In health, nothing replaces science,” he said.

“Once again, the STF comes and brings the answer that science has given us,” he said in relation to the requirement for the Covid-19 vaccine to enter the country, a measure recommended by health authorities around the world.

He highlighted that the new variant, Ômicron, which appears to be more transmissible than the previous ones, should cause concern with congestion in hospitals and Intensive Care Units (ICUs) and precaution is the best path, also recommended by the Constitution.

“In the face of uncertainty and gravity, it is better to use all possible measures to be on the safe side”, he commented.

Baronovsky also recalled that the requirement of proof of vaccination for travelers in Brazil precedes the pandemic, in cases such as the immunization against yellow fever.

“On this issue, it must be governed by reciprocity: if other countries demand vaccination from Brazil, why won’t Brazil demand it from outsiders?”, he asked.

He assesses, however, that many issues outside the traditional scope of the STF, in particular regarding the pandemic, have been brought before the Court. “There is an excess of protagonism [do STF] in the judicial responses.”
