In the frame Freedom of Opinion this Thursday (23), commentator Ricardo Baronovsky spoke about the mandatory use of masks in Brazil, based on a survey carried out by the Datafolha Institute this week.
According to the survey, 48% of Brazilians understand that the accessory must remain mandatory in all spaces. For 44%, the item should only be required indoors, while 8%, on the other hand, advocate the complete release of the accessory.
For the professor of Constitutional Law, the use of masks must follow the principle of proportionality in the scope of public health. “Proportionality is revealed in what is common sense, fair and equitable through three vectors: adequacy, necessity and proportionality in the strict sense”, said Baronovsky.
“Adequacy means that the measure must be reputable and reach a necessary end, and it is medical consensus that the contagion is 99% lower when all people are wearing masks. Necessity means that the measure must entail the least possible burden for health – within the options we have, such as medication and hospitalization, the mask is the least burdensome. Proportionality is a balance between means and ends, which is also fulfilled”, he explained.
Faced with the advance of the Ômicron variant, and the possible new strains that may arise as a result of the spread of the disease, the commentator took a stand alongside the 48% of the population who defend the mandatory use of masks in all spaces.
“It is adequate, necessary and has a balance between ends and means, that is, keeping the masks, in the light of Law, is also a proportional measure”, he said.
