Barroso calls for a public hearing on the ANS’s taxing role

Minister Luís Roberto Barroso, of the Federal Supreme Court, convened a public hearing to discuss the exhaustive role of the National Supplementary Health Agency (ANS).

Hearings will be held in September. The determination for information to be provided and for the Attorney General’s Office (PGR) and the Attorney General’s Office (AGU) to express themselves remains maintained.

“For all the foregoing, without prejudice to the information to be provided by the defendants, as well as the statements of the Attorney General of the Republic and the Attorney General of the Union, I convene a public hearing, under the terms above, for the 26th and 27th of September, 2022. I now open a deadline for any interested parties to express their views, which must be done exclusively by emailing [email protected], until July 29, 2022″, Barroso decided.

The minister is the rapporteur of at least three actions in the STF that deal with the matter. The last one was filed by Podemos on the 25th.

On June 8, the 2nd Section of the Superior Court of Justice (STJ) decided that the list is exhaustive. In other words, operators are only required to cover what is on this list. The ministers also established that any procedures with medical indication, scientific evidence and without equivalents included in the list may have the coverage requested and accepted by the plan.
