Barroso may decide AGU appeal before judgment on vaccine passport

Minister Luís Roberto Barroso, from the Federal Supreme Court (STF), is analyzing the appeal presented on Monday night (13) by the Attorney General’s Office in the lawsuit on the vaccine passport. According to sources linked to the STF, the decision may still be published this Tuesday (14), before the other ministers of the Supreme Court begin to analyze Barroso’s injunction on trial by the virtual plenary.

On Saturday (11), following a request from Rede Sustentabilidade, the minister determined that the federal government adopt the passport for the vaccine against Covid-19 for travelers entering Brazil. The AGU appealed and asked for some clarification and changes in the minister’s decision, so that Brazilians who do not have a vaccine passport who come from abroad can enter Brazil after five days of quarantine and testing.

“Apparently, however, this entry restriction imposes a disproportionate burden on Brazilian citizens from abroad and also on foreigners residing in Brazil – expressly protected by the wording of Article 5, caput, of the Constitution – preventing them from returning to the country of domicile”, affirmed the AGU in the appeal filed with the STF in the action presented by the Network.

STF analyzes injunction from Wednesday (15)

From 12:00 am on Wednesday (15), the ministers of the Supreme will analyze, through the extraordinary virtual plenary (trial mode in which ministers register their votes and positions in the STF system, without a session for individual reading of each vote), whether or not Barroso’s decision is upheld.

The analysis of the case runs until 23:59 on Thursday (16).
