The minister of the STF (Supreme Federal Court) Luís Roberto Barroso upheld, in his vote presented in the virtual plenary of the Court at dawn this Wednesday (15), the decision for the mandatory presentation of proof of vaccine, in addition to the test for detection of Covid-19, for travelers arriving in Brazil.
The trial of the preliminary injunction began this Wednesday and ends at 23:59 on Thursday (16).
Barroso determined last Saturday (11) that the passport for the vaccine is mandatory for every foreign traveler who disembarks in Brazil.
Only those dispensed for medical reasons or those who come from a country where there is proven no vaccine available or for exceptional humanitarian reasons will be exempt from presenting the vaccine passport.
In his decision, Barroso emphasized that Brazilians and foreigners residing in Brazil must also present a negative test and proof of immunization. “This is about a measure to induce vaccination, to prevent the risk of contamination of the people who live here from increasing on their return,” he wrote in his decision.
If they do not have the “vaccination passport” they must undergo a five-day quarantine, followed by a PCR test. For Barroso, “it is up to the health authorities to regulate the monitoring and consequences of non-compliance with such determinations”.
On Monday night (13), the Attorney General’s Office (AGU) filed an appeal against the minister’s decision. The AGU asked Barroso to change the decision to ensure that “Brazilians and foreigners residing in Brazil can return to the country in the event of not carrying proof of immunization, provided they comply with the foreseen quarantine”.
After the AGU’s appeal, the minister clarified, on Tuesday night (14), and stated that Brazilians and foreigners residing in Brazil who left the country before the date of the decision are subject to the previous rules, that is, they are not required to present proof of vaccination.
