The controversial video that has gone viral on TikTok

Jemima usually shares videos on her account which they detail her various experiences working at the barwith her latest at TikTok show how it handles a situation where a customer’s card is declined.

“A taste of some of the situations you have to handle as a bartender on Broadway in Nashville,” reads the text on the screen.

In the video, Jemima shows how he tried to charge the man $27 for shots when his card was declined.

According to June, the bar she works at in Nashville has an alcohol counter where every drop must be recorded, and if a customer doesn’t pay, then she does.

“Well, I need $27 right now because you already got the shots,” June can be heard saying in the clip. The man then allegedly told her his friend would pay for the drinks, but June, realizing the man was drunk and likely wouldn’t be coming back, demanded his wallet as a guarantee.

“Go get me $27 and I’ll give you your wallet back,” she tells him as more customers begin to line up at the bar. “You’re wasting my time, all these people are waiting for drinks.”

Almost an hour later, the man returned with his friend to pay the bill.

The videowhich has been shown 12.2 million times since last Saturdayresonated with hundreds of people in the service industry, while countless viewers left comments praising her for her handling of the situation.

“Very professional!!! Customers have no right to be angry, at the end of the day you are doing your job and protecting the liquor license,” one user commented.

“Bartending at a busy bar like this looks like the most stressful job ever,” read one top comment, while others joked about the man’s wallet.

“Two cards declined for a $27 payment and he thinks you’re going to take what out of his wallet?” one user joked.

“What does he think you’re going to steal from his wallet? He has no money at all,” argued another. Some users seemed more concerned about the alleged amount of alcohol.

“I don’t know about Tennessee labor laws, but most states. They can’t legally force you to pay for an unpaid bill because that’s considered theft,” said one user.

What does the law say about withholding money from employees’ wages?

According to the Labor Department, the New York Post reports, employers of tipped workers are not allowed to “make deductions for walkouts, cash register shortages, breakages, uniform costs, etc.,” because deductions would result in the worker receiving less than the minimum wage.

However, there is still a gray area when workers are paid above the absolute minimum wage or have entered into an agreement to tip. The outcome as to whether or not it would be legal to ask the waiter to cover the losses will depend on the situation and how high their base salary is.
