The Berlin Administrative Court in Germany today ruled the rejection of asylum seekers to the border, after appealing three Somalis, who were sent back to Poland by Frankfurt of Oder. According to the court, asylum seekers cannot be returned without following the planned “Dublin Procedure” and, as the court spokesman said, this is the first such decision following the introduction of more intensive border controls by the new government. Police justified the rejection of the three Somalians on the grounds that they were entering a safe country, but if the immigrants expressed their willingness to receive asylum, they had to be allowed to cross the border – not necessarily without restriction. In such a case, the Federal Migration and Refugee Service examines which state is responsible for the process and is usually the Member State of the European Union where immigrants first arrived.
