Bolsonaro defends the exclusion of illegality for police officers

President Jair Bolsonaro defended the exclusion of illegality for security forces this Thursday (25). The statement was made during the ceremony to hand over equipment to the National Border and Border Security Program.

“A police officer cannot finish a mission one day and receive a visit from the bailiff the next,” Bolsonaro said.

“I know that it is very difficult to respond to a process being right and knowing the possibility of being convicted,” defended the president. “We do not want, with this, carte blanche to kill. We want the right not to die”, he said.

Excluded from illegality

Defended by Bolsonaro, the exclusion of illegality allows any citizen to commit an act – which can be considered criminal – without answering for it. It is the case of acting in self-defense, for example.

The Brazilian Penal Code provides for the exclusion of illegality in three cases: strict compliance with legal duty, in self-defense and in a state of need. According to the Federal Constitution, anyone who commits excesses can be punished.

The expansion of the illegality exclusion was already foreseen in the anti-crime package presented by the Ministry of Justice and Public Security in 2019, but ended up being rejected by the Chamber of Deputies, in the final vote on the bill.
