Bolsonaro empowers AGU to streamline “social package”

President Jair Bolsonaro issued a decree to empower the Attorney General’s Office and allow it to have the final word on whether or not government actions this year violate electoral legislation.

The objective is to speed up the legal assessment of measures taken until the election, in view of the restrictions that the legislation imposes on the government to avoid using the public machine during the reelection campaign. In practice, it gives the body the final word on legality of the measures.

Today, the legal consultancies of each ministry issue opinions on the programs in their areas, which eventually opens space for conflicting understandings between the departments when an eventual program involves more than one ministry. This ends up delaying the process of implementing the measures.

With the decree, the ministries continue to give their opinions, but the final word, especially with regard to electoral legislation, rests with the AGU.

This comes at a time when the government is betting on the approval of a proposed constitutional amendment that grants benefits to the population to try to alleviate the impact of fuel inflation.

Decree 11,104 was published in the Official Gazette of the Union and says that “it is incumbent upon the Attorney General of the Union to issue an opinion on: I- the constitutionality and legality of proposals for normative acts submitted to it; and II – topics in proposals for normative acts that generate doubts as to the
compliance with the rules of Electoral Law and Financial Law, in the last year of the presidential term.”
