Bolsonaro forces stations to display fuel prices before and after ICMS ceiling

In this Thursday’s Official Gazette (7), President Jair Bolsonaro (PL) issued a decree that obliges gas stations to display the fuel prices practiced on June 22, 2022, the date prior to the sanction of the bill that established a ceiling for the Tax on Circulation of Goods and Services (ICMS).

According to the decree, establishments “must inform consumers, in a correct, clear, precise, ostensible and legible way, of the prices of automotive fuels practiced in the establishment on June 22, 2022, so that consumers can compare them with the prices charged at the time of purchase.

The measure comes into force this Thursday and will be valid until the end of the year, the same period established for the ICMS ceiling. There is no punishment foreseen for the stations that do not display the different values.

The decree also establishes that fuel prices, ICMS, PIS/Cofins and Cide-combustíveis must be reported separately.

Until this Wednesday (6), 25 states and the Federal District had announced the reduction of the Tax on the Circulation of Goods and Provision of Services (ICMS) on fuel, according to a survey carried out by CNN .

They are: Alagoas, Amapá, Amazonas, Bahia, Ceará, Espírito Santo, Goiás, Maranhão, Mato Grosso, Mato Grosso do Sul, Minas Gerais, Pará, Paraíba, Paraná, Pernambuco, Piauí, Rio de Janeiro, Rio Grande do Sul, Rio Grande do Norte, Rondônia, Roraima, Santa Catarina, São Paulo, Sergipe and Tocantins, in addition to the Federal District.

Bolsonaro sanctioned the bill that establishes the ceiling for ICMS on fuel on June 23, with a series of vetoes to the financial compensation model for states due to the limitation of the tax rate.

One of the vetoes that should cause the most reaction from the National Congress is the passage that guarantees the minimum constitutional transfer of resources to education, health and the Fund for the Maintenance and Development of Basic Education and for the Valorization of Education Professionals (Fundeb) compared to with the situation in force before the law.

The project approved by Congress provided that the Union would compensate the other entities of the Federation so that these constitutional minimums would have the same resources as before. It also provided that the states, the Federal District and the municipalities benefiting from the financial compensation by the Union should maintain the proportional execution of these minimum constitutional expenses.
