In a presidential message published in the Official Gazette of the Union this Friday (7), President Jair Bolsonaro informed the National Congress that he decided to fully veto the project that created a new debt installment program for micro and small companies participating in the Simples Nacional, including individual microentrepreneurs (MEI) and companies undergoing judicial reorganization.
In the justification, the government states that, after consulting the Ministry of Economy and the Federal Attorney General’s Office, they understood that “a legislative proposal incurs in a defect of unconstitutionality and contrary to the public interest, since, by instituting the tax benefit, it would imply a waiver of revenue”.
The veto of the project now needs to be analyzed by the National Congress.
The program
Authored by the Senate, the text was approved in December, and the payment in installments, called the Debt Payment Rescheduling Program under the Simples Nacional (Relp), is aimed at indebted companies, which could adhere to it until the last day of the month following the publication of the future law, and the first installment must be paid on this date to have the request granted.
Under the project, the taxpayer would have discounts on interest, fines and charges proportionally to the drop in sales in the period from March to December 2020 compared to the period from March to December 2019. Companies inactive in the period will also be able to participate.
