Brazil has 480 traffic crime cases per day in 2024, shows CNJ

Brazil has already registered, on average, 480 new traffic crime cases per day in 2024, according to data from the National Council of Justice (CNJ).

A survey by VLV Advogados shows that, in total, 116,597 actions were registered between January and August this year on the CNJ website.

The body explains that “traffic crimes” constitute 10 articles provided for in the Brazilian Traffic Code within the area of ​​Criminal Law.

Among the infractions are: manslaughter while driving a motor vehicle, leaving the vehicle away from the scene of the accident to escape criminal or civil liability, driving with altered psychomotor capacity due to the influence of alcohol and participating in a race or automobile competition on public roads.

Among the courts that registered the most cases until August 2024 are the following states:

  • Rio Grande do Sul: 21,283
  • Minas Gerais: 17,197
  • São Paulo: 13,689
  • Paraná: 7,311
  • Santa Catarina: 6,775

Amapá, Sergipe and Acre have the lowest numbers, with 683, 638 and 457 actions in the same period, respectively.

The criminal lawyer at VLV Advogados, João Valença, told CNN that penalties for traffic crimes can reach up to 10 years in prison.

“The penalties range from fines and suspension or revocation of license, arrest and imprisonment of up to 10 years in cases that result in death. It can also be applied in situations of bodily injury due to cracks or in cases of fleeing the scene, failing to provide assistance and driving the vehicle without carrying a license”, explains the specialist.

He also warns that drivers must pay more attention in traffic. “Negligence in small, day-to-day actions behind the wheel can generate severe consequences, both in the criminal sphere and in the lives of the victims and families involved.”

From 2022 to 2023, the research shows a 3.76% increase in registrations. The trend is still for a slight drop for 2024, with a projection of 174,895 cases this year, compared to 178,512 last year.

The lawyer also advises how to act if someone is accused of committing a traffic crime.

“The accused must also report to the police station to make the necessary statements and collaborate with the investigations, providing the necessary evidence and information, when available,” he concluded.
