The German Court ruled that the German state of Hessen must compensate Brazilians Kátyna Baía and Jeanne Paolini, who spent more than a month detained in Frankfurt, in March last year, after having their suitcases exchanged for luggage loaded with drugs.
The decision which CNN had access to last Thursday (29). Now, the local Public Ministry has a period of one week to appeal.
“They theoretically have a period of one week to appeal, so that the decision only becomes final after this period has elapsed. However, the MP himself considered them innocent, so it is unlikely that they will appeal”, declared the Brazilians’ defense.
According to Chayane Kuss, a Brazilian lawyer who works in Germany and defends Kátyna and Jeanne, the state of Hessen must compensate the two due to the arrest, as both were convicted innocent.
In December last year, the German court closed investigations against the Brazilian women.
The amounts, losses and compensation that will be considered must be discussed later, according to Kuss.
However, local law determines compensation of 75 euros per day of unjust imprisonment, the total amount for each of the Brazilian women must not be less than 2,850 euros, which is equivalent to R$15,312, at the current exchange rate.
The decision occurred in the same week that the Brazilian and German governments signed a cooperation agreement to strengthen the fight against organized crime, money laundering and drug trafficking.
The event took place last Monday (26) and was attended by the Minister of Justice and Public Security, Ricardo Lewandowski, as well as the Minister of the Interior and Territorial Cohesion of Germany, Nancy Faeser.
The agreement establishes the exchange of information and technologies, personal exchange for training and professional development programs, in addition to joint action by teams in investigations.
According to the defense, the Brazilian women were “very happy” after reading the German State’s decision, making official the duty of compensation and repair of losses.
A CNN also contacted the German Embassy in Brazil, but did not receive a response until the publication of this report.
