The Regional Labor Court of the 2nd Region determined, this Tuesday (2), that bus drivers and fare collectors in the capital of São Paulo must guarantee 100% of the fleet circulating during peak hours, from 6 am to 9 am and from 4 pm to 7 pm, this Wednesday (3).
The decision was taken after the strike announcement by the Union of Drivers and Workers in Urban Road Transport of São Paulo (SMTTRUSP), last Friday (28).
The injunction was granted by rapporteur judge Davi Furtado Meirelles, who also defined a minimum of 50% of the workforce in other periods, if it is decided to strike from midnight this Wednesday (3).
According to the court’s action, if there is non-compliance, a daily fine of R$100,000 will be applied to the category’s union and the union of public transport companies (SPUrbanuss).
A CNN the SMTTRUSP stated that it will be decided in plenary session on Tuesday afternoon (2) whether the strike will be maintained. Last Friday (28), the association said that the strike should last 24 hours and will begin in the first minute of Wednesday (3).
In a statement, the Union of Urban Passenger Transport Companies of São Paulo said that it “hopes that the goodwill of the category prevails and that the urban passenger transport service, essential to the mobility of the population, is fully maintained”.

In a decision taken at an assembly held last Friday (28), bus drivers and fare collectors demanded a 3.69% adjustment for inflation (IPCA), in addition to a further 5% gain.
Since the decision, the union has stated that new negotiations may take place if a positive counterproposal is sent by the employers’ union.
In a statement, the Court stated that the Municipality of São Paulo and SPTrans have been negotiating with drivers and collectors items such as salary adjustments, working hours, meal vouchers, profit sharing, life insurance, among others.
The Union of Urban Passenger Transport Companies of São Paulo presented this Tuesday (2) a proposal for a 3.60% salary adjustment to employees in the sector.
According to the association, this index is “above the INPC of the period, plus any salary variation defined by FIPE, in the salary meter”.
