Cade investigates whether Petrobras committed discriminatory conduct in sales to refineries

The Administrative Council for Economic Defense (Cade) launched, this Monday (5), an administrative inquiry to investigate possible violations of the economic order by Petrobras. The determination was signed by the general superintendent, Alexandre Barreto de Souza.

The agency wants to know whether the state-owned company has promoted discriminatory practices in the sale of oil to private refineries. In a note to CNN, Petrobras responded that it “acts in full compliance with current legislation and remains available to present the pertinent data and clarifications to CADE.”

In June, CADE had already started a preparatory procedure on the case and registered indications that call for a more in-depth investigation. The purpose of the inquiry is to identify whether Petrobras actually engaged in irregular competition.

For this, the agency intends to listen to market agents, such as companies that operate in oil exploration and production and also companies that work in oil refining.

In a note sent to CNN, Cade highlighted that the Brazilian refining market is going through an opening, after a Term of Commitment signed by Petrobras, which provides for the sale of eight refineries, four of which have already been sold, one of them with privatization completed. since January.

In another inquiry by Cade about Petrobras, the council requested that the state-owned company present detailed information that clarifies the effects of a notice to the market published in July.

The report disclosed that the company’s Board of Directors and Fiscal Council will now oversee fuel pricing policy. In this case, Petrobras has until September 16 to provide the information.
