Candidates called by mistake after competition will receive compensation

The Federal Court of Tubarão, in Santa Catarina, condemned the Brazilian Institute of Geography and Statistics (IBGE) to indemnify a candidate who was summoned by mistake after holding a contest.

According to the decision of judge Ana Lídia Silva Mello Monteiro, the IBGE must pay her the amount of 12 minimum wages, approximately R$ 21 thousand, in addition to another R$ 10 thousand in moral damages.

The girl had resigned from the job she had in Criciúma, in August 2022, after receiving news of the hiring.

“If the IBGE had not summoned the plaintiff, she would not have resigned from her job,” said the judge. “Furthermore, the summons did not materialize due to an error on the part of the defendant, which was recognized by its own server”, considered Ana Monteiro, to conclude that “therefore, the responsibility of the IBGE remains evident”.

Also according to the decision, the woman would be hired for the position of census coordinator at the IBGE, in the city of Braço do Norte, with a remuneration of R$ 3.1 thousand.

However, before starting the job, she was warned by a server of the agency that it would be unfeasible to assume the position, since the contest would no longer be valid.

“The moral damages suffered by her are evident and must be compensated by the defendant. In this case, the plaintiff, due to the conduct of the defendant, believed that she would assume the position of census coordinator for a sub-area of ​​the IBGE and resigned from her job. As a result, she remains unemployed ”, added judge Ana Monteiro.
