Cape that called Lieutenant “Bunduda” appeals to the Superior Military Court

Cabo Expedito Ferreira Neto, sentenced to arrest for calling a “butt” lieutenant, appealed from the decision to the Superior Military Court (STM). The information was confirmed by the court on Friday (16). The military was sentenced to 1 year imprisonment, in open regime, for the crime of contempt to the superior, but the penalty was replaced by restrictive measures.

The decision in the first instance was issued by the Permanent Council of Justice for the Union Military Justice Air Force, in Campo Grande (MS), last Wednesday (14). Now, the STM will judge the case again in the second instance, in Brasilia, to decide on the permanence of the conviction or the acquittal of Expedito.

“The defense of Expedito Ferreira Netoirritated by the content of the sentencing sentence contained in event 123, filed an appeal, ”says the military defense appeal document.

Understand the case

The military was denounced by the Military Public Prosecution Service (MPM) in September 2024 after different cases of offenses to the lieutenant. In March, during a Women’s Week action, Expedito told the military that she was “beautiful and the“ friendlier lieutenant ”, even after she asked him to stop, as she was engaged from another military and was embarrassed.

In June, according to the complaint, the cable made insinuations and mentions of a particular nature that disrespected the lieutenant, in a situation where the two would take influenza vaccines to a Basic Health Unit (UBS).

“Ah, Lieutenant, what a pity that his heart already has a owner,” he told the military, who denied and said he was marked and loved the groom. Upon arriving at UBS, the corporal said that “their daughter would be beautiful, because she is a butt and he is also a butt and was going to be a big daughter”, as shown the complaint of the MP.

The prosecution’s accusation stressed that Expedito injured the decorum and dignity of the lieutenant. “In addition to the precepts of hierarchy and discipline, the accused focused on the practice of military crime provided for in Article 298 of the Military Penal Code – crime of contempt to the superior.”

Article 298 of the CPM establishes the crime of “disagreeing superior, offending it dignity or decorum, or seeking to depress its authority.”

Asked by the MP, the military confirmed that he did “compliments” to the lieutenant and claimed that he did not “evil”. During the process, the defense of the accused stressed that he was not intended to disrespect the offended, “considering that the compliments given occurred without any intention of offense and expressed words of courtesy among co -workers, without evil or intention to embarrass.”

After the testimonies and the presentation of the evidence, the Council of Justice understood that “evidence removes any doubt about authorship and materiality.”

“The expressions were unambiguous sexual connotation, with direct insinuations about the lieutenant’s body and invitations of romantic/intimate content, without any relationship of intimacy or consent. Such acts overflow the field of a simple praise, demonstrating to disregard respect, attain dignity and vilify decorum, disregarding the public function to which the military officer said.

The court replaced the conviction to arrest with restrictive measures, based on the conditional suspension of the execution of the sentence for a period of three years:

  • Prohibition of contact, whether face -to -face or virtual, with the offended;
  • Maintenance of a minimum distance of 300 meters from the offended;
  • Prohibition of service fulfillment in conjunction with the offended;
  • Duty to present quarterly in this judgment
