Minister Carmen Lúcia, of the Federal Supreme Court (STF), sent, this Wednesday (5), to the Attorney General’s Office (PGR) and to the Federal Attorney General (AGU) letters for the two bodies to manifest themselves in action that deals with the vaccination of children aged 5 to 11 years against Covid-19.
The STF considered that it had not received, until Tuesday (4), the manifestations of the Presidency of the Republic and the Ministry of Health, which had been requested last week. The sending of official letters for manifestation by the AGU and the PGR is customary and had already been defined by Minister Carmen Lúcia last week.
“We request, as a matter of urgency and priority, information from the President of the Republic and the Minister of Health on what is stated in the initial part of this argument, to be provided within a maximum and non-extendable period of five days, regardless of the period of forensic recess. Next, the Federal Attorney General and the Federal Attorney General must express their opinion within a maximum period of five days, which will run in common through the electronic form of the process”, defined the minister.
Carmen Lúcia had also determined that, “after the deadlines have passed and with or without a statement within the exact period that has been declined, the case files must be returned to me with urgency and priority, regardless of the period of forensic recess”.
In the action presented to the STF, the National Confederation of Metallurgical Workers asked that childhood vaccination be mandatory and that the public consultation carried out by the folder on the matter be cancelled.
The entity asked the STF to “determine that the Federal Union adopt the measures recommended by the WHO and by Anvisa, in particular, to make the vaccination of children and adolescents mandatory, urgently including them in the National Immunization Program Plan of the Ministry of Health ( PNI/MS). After all, the subjective public right to health represents an unavailable legal prerogative guaranteed to the generality of people by the Federal Constitution in its article 196”.
