THE Court of Justice of the State of Rio de Janeiro (TJRJ) decided, for unanimity keep the pre -trial detention of Monique Medeiros accused of the death of his son, Henry Borel in March 2021.
The decision of 7th Criminal Chamber occurred after the minister of Supreme Federal Court (STF), Gilmar Mendes for reevaluation of prison .

Monique’s defense argued that the reevaluation of pre -trial detention should be done by the first instance judge. However, the TJRJ reiterated that the revision of the precautionary measure should be carried out by the same organ that decreed it, in this case, the 7th Criminal Chamber .
The Judge Rapporteur, Joaquim Domingos de Almeida Neto justified the decision by stating that it is “absolutely essential to safeguard the means and ends of the criminal action of origin.”
Guarantee of public order
The Judge Joaquim Domingos de Almeida Neto highlighted the importance of maintaining preventive custody for the guarantee of public order convenience of instruction and to ensure the application of criminal law. The decision reinforces the need for prison of Monique Medeiros for the continuation of the process.
The request for freedom was based on aLegaded aggressions suffered by Monique in the prison. The magistrate determined that the petitions about the aggressions suffered by Monique in the Talavera Bruce Penal Institute and the alleged omission of the authorities, be sent to the 2nd Vice Presidency of the TJRJ and to Attorney General of Justice . Denunciations of assault will be determined by the competent bodies.
Monique and the former alderman JAIRO SOUZA SANTOS JÚNIOR are defendants by double qualified homicide in addition to accusations of obstruction of justice and threats to witnesses .
Remember the case
Councilman and doctor Jairo Souza Santos Júnior, known as Dr. Jairinho, along with the mother of little Henry Borel, Monique Medeiros, were arrested by the Rio de Janeiro Civil Police on suspicion of involvement in the death of the 4 -year -old boy.
Investigators also believe that there was torture against the child, but that the mother did not witness the scene. On death day, boy Henry Borel spent the day with his father and only at night was delivered to Monique.
The prior expert report indicated to the police that the boy had serious injuries throughout his body. In addition to the death of Henry, the delegate Henrique Damasceno heard several witnesses, among them, ex-girlfriends of Jairinho and his ex-wife. The parliamentarian is suspected of aggression and domestic violence.
