CASE VICTORY: MAICOL LAWYERS QUESTION SUSPECTION CONFESSION

Maicol’s defense Antonio Sales dos Santos defends the nullity of the testimony used by the São Paulo Civil Police as a confession of the crime. An article of the Authority Abuse Law would justify the nullity of the testimony.

The defense reiterates the irregularities In the supposed confession of Maicol: absence of lawyers, night interrogation and psychological coercion . Given this scenario, they question the police motivation for psychiatric expertise. The defense raises the hypothesis that the expertise is an attempt to validate a confession obtained under questionable circumstances .

The lawyers argue that this night interrogation makes invalid Maicol’s confession and reinforce that he did not formally confess the crime. They claim that the Article 18 of the Authority Abuse Law prohibits prisoners to police interrogation during night rest, making the procedure null .

The defense reiterates its position that There was no formal and legal confession by Maicol. In a statement, lawyers question whether there would be an attempt to validate a confession extracted under “questionable circumstances.” They still ask the police if the goal would be to “end investigations at any cost, even to the detriment of the fundamental guarantees of the investigated.”

Defenders emphasize the importance of due process of law and respect for the Federal Constitution and international human rights treaties. They commit to adopt all necessary measures to ensure a fair trial For Maicol, without procedural addictions or arbitrariness.

Absence of lawyers and coercion

In addition to the illegality of the night interrogation, the defense reiterates the previous arguments. For defenders, nullity would be guaranteed in absence of lawyers during interrogation and Psychological coercion which he claimed to lawyers would have.

They maintain that any statement by Maicol without the presence of his lawyers “Offends procedural legislation” and “It lacks legal validity” .

The São Paulo Civil Police considers Maicol the only perpetrator of the crime. Delegate Luiz Carlos do Carmo classified Maicol as “psychopath” and stated that he was “obsessed” by the victim.

THE CNN asked for a position to Civil Police of São Paulo On coercion allegations and defense speech about conducting investigations, however, there has been no return so far. The space is still open.
