CCJ approves PEC of Precatório by 16 votes to 10; text goes to plenary in the Senate

The Constitution and Justice Committee (CCJ) of the Senate approved this Tuesday (30), by 16 votes to 10, the PEC dos Precatórios, which makes room in the 2022 Public Budget. .

Now, the PEC will be appreciated by the House’s plenary, where it will be voted on in two rounds and needs the approval of three-fifths of the parliamentarians. As the text was modified by the senators, after that it still has to undergo a new analysis by the Chamber of Deputies before going to promulgation.

Senator Fernando Bezerra Coelho (MDB-PE), government leader and rapporteur of the PEC dos Precatórios in the Senate, accepted some amendments presented by lawmakers in their opinion on the proposal, to increase the chance of approval of the text.

The main change is the removal of the Fundef (Funding for the Maintenance and Development of Elementary Education and the Appreciation of Teaching) from the spending ceiling — constitutional limit for annual government spending.

These judicial debts with the states amount to around R$16 billion. Under the PEC, 40% of this amount will have to be paid in the first year.

Another important change was putting food court orders on the priority list for payment.

“We removed the Fundef payment from the ceiling. By doing this, I opened up a space of almost R$ 10 billion to meet the food precatory regulations”, said Bezerra.

On the priority list for payments are those who will receive smaller amounts, up to R$ 66,000, people aged 60 or over and people with disabilities.

The text of the PEC dos Precatórios has as its backbone to pay half of the value of the Union’s judicial debts next year, and to change the calculation of the spending ceiling, which would open up R$ 106 billion.

Last week, Bezerra had already brought changes in relation to the text that came from the Chamber, such as ensuring that all open space in the budget is linked to the payment of social assistance. In addition, it established the payment of R$ 400 from Auxílio Brasil as permanent.

– Auxílio Brasil was transformed into a permanent program and conditioned to the fiscal space opened by the correction of the Spending Ceiling and no longer by the limit on the payment of court orders;

– The requirement of a source of financing for the Brazilian Aid was withdrawn;

– It was defined that the revenues received by states and municipalities for the payment of precatory orders from Fundef will be applied in the maintenance and development of public elementary education, and in the enhancement of its Magisterium;

– At least 60% of the amount must be transferred to teaching professionals, including retirees and pensioners, in the form of an allowance;

– The National Congress will annually analyze the fiscal risks of ongoing lawsuits and forward its conclusions to the presidents of the Federal Supreme Court, Superior Courts and Regional Federal Courts, as well as to the Attorney General of the Republic;

– The increase in fiscal space was linked to the expansion of social programs to fight poverty and extreme poverty and expenditures on health, social security and social assistance;

– The inclusion, in the budget of public law entities, of funds necessary for the payment of their debts, arising from final and unappealable judgments, contained in court orders presented until April 2, was made mandatory, payment being made by the end of the next year, when their values ​​will be monetarily updated.

Bezerra avoided risking a score in the plenary, but says he is confident he has a minimum of 49 senators in favor.
