Following a request from the Federal Public Ministry (MPF), the Federal Court of Acre ordered the IBGE (Brazilian Institute of Geography and Statistics) include fields on sexual orientation and gender identity in the 2022 Census.
The institute has a period of 30 days to inform the Court of measures taken to comply with the determination.
The action was signed by federal judge Herley da Luz Brasil, from the Federal Court of Acre, and is valid throughout the national territory.
“The omission that the Brazilian State has historically used to the detriment of the LGBTQIA+ population is relevant and needs to be corrected. While persecution, sickening, death, holocaust and other criminal discrimination were and/or are practiced by action, there is also the violation of rights by state omission”, the decision states.
Among the arguments presented, the document points out the need for data that allow the creation of public policies in favor of the LGBTQIA+ population and uses international examples.
According to the decision, the institute may include the fields using the methodology it deems appropriate.
It is worth mentioning that sexual orientation refers to a person’s affective and sexual inclination, while gender identity is related to the gender with which the individual recognizes himself.
At the end of May, the IBGE released, through the National Health Survey (PNS), the country’s first official data on this subject. According to the survey, at least 2.9 million Brazilians over 18 years of age declare themselves to be homosexual or bisexual.
