CGU notifies Aneel about audit to evaluate measures taken regarding blackouts

The Comptroller General of the Union notified, this Monday (14), the National Electric Energy Agency (Aneel) announcing that it will carry out an audit with the objective of “evaluating the compliance and suitability of the measures taken” by the agency.

The initiative takes place in the face of electricity supply interruptions, especially in São Paulo, whose distribution is under the responsibility of the concessionaire Enel. Since a storm in the capital of São Paulo last Friday (11), hundreds of thousands of people have suffered from power outages.

A letter signed by the CGU minister, Vinícius de Carvalho, was sent this Monday to the general director of Aneel, Sandoval de Araújo Feitosa Neto.

In the document, the minister states that, initially, the CGU will focus on cases occurring within Enel’s coverage area and will analyze:

  • Aneel’s performance during the power outage in November 2023;
  • the regulatory and inspection measures, including through the Public Services Regulatory Agency of the State of São Paulo, adopted by Aneel with Enel to ensure that similar events would not occur again;
  • the monitoring process adopted by the federal regulatory agency regarding possible obligations assumed by the distributor to prevent cases like the one in November 2023 from occurring again;
  • the measures adopted by Aneel to address the demands of the supervisory ministry regarding increasing the quality of the provision of electricity distribution services in the region served by Enel Distribuição São Paulo;
  • Aneel’s performance during the power outage this October.

Regarding this last point, Minister Vinícius de Carvalho asks that the CGU team can monitor:

  • situation or emergency rooms installed within the scope of Aneel with the aim of discussing service in regions still impacted by the lack of electricity;
  • relevant meetings held by the agency to address the matter;
  • visits conducted by the agency to monitor Enel’s actions in this month’s case.

He also asks Aneel to share with the CGU all relevant information received throughout the incident investigation process from both last year and this month.

Furthermore, it requests that a server be designated to liaise between the audit team and the units involved, “in order to enable the timely presentation of documents, statements and clarifications necessary to conduct the audit”.

“I highlight that, after completion of the work execution phase, an audit report will be issued, which will be forwarded to the agency and, as appropriate, to other competent authorities”, says the CGU minister in the document sent to Aneel.

Public agents may be held responsible for any failures found throughout the process. Earlier, Carvalho said that, as a last resort, the cancellation of Enel’s concession contract could be at stake.
