For Aras, pardon for Daniel Silveira is valid but does not free him from ineligibility
The Attorney General of the Republic, Augusto Aras, validated the pardon of President Jair Bolsonaro (PL) to federal deputy Daniel Silveira (PTB-RJ), but with limits. In an opinion, Aras said this Wednesday to the Federal Supreme Court (STF) that “the decree of grace is a political act of the private competence of the President of the Republic, who has broad freedom to define the concession criteria”.
At the same time, for the PGR, the effects of the pardon are restricted to “criminal conviction, not reaching eventual accountability in other spheres, such as electoral”. This means that for Aras, the presidential pardon frees Daniel Silveira from conviction but not from ineligibility.
