Chamber approves minimum transfer of 40% of the penitentiary fund to states and municipalities

The plenary of the Chamber of Deputies approved this Tuesday (10) a Provisional Measure that sets at least 40% the mandatory transfer of Funpen (National Penitentiary Fund) by the Union to the funds of states, municipalities and the Federal District.

According to federal deputy Bia Kicis (PL-DF), rapporteur of the matter, which is now being analyzed by the Federal Senate, the legislation to be changed establishes that transfers from the Union to the states and municipalities related to Funpen were limited to a fixed percentage of 40% of the fund’s budget allocation, “no more, no less”.

Now, with the new wording given by the Provisional Measure, the 40% becomes a minimum transfer threshold, which can be exceeded, if necessary, he said.

“While it is true that prison managers need a minimum threshold as a starting point for their respective planning, it is also undoubted that different circumstances at the moment often impose greater transfers, especially when it comes to a volatile scenario such as prisons. in our country,” Kicis wrote.

In December last year, the federal government stated that “with the Provisional Measure, it will be possible to make a greater contribution to finance activities and programs for modernization and improvement of the prison system of federal entities”. Also “enabling better implementation of the principles and rules of the National Penitentiary Policy and, in the end, the promotion of human dignity in the system”.

When reporting the Provisional Measure, Kicis rejected two suggestions for changes to the text edited by President Jair Bolsonaro (PL) at the end of December last year.

One raised the percentage to be transferred to 75%, in addition to determining that at least 25% of Funpen resources should be applied to the construction and renovation of penal establishments.

Kicis opined for the rejection of the amendment, citing public policies and legislation that already pursue these objectives, in addition to functional obstacles to the application of these percentages.

Another suggestion proposed the inclusion of the construction of specific penal establishments to hold gays, lesbians, bisexuals, transsexuals and transvestites, in addition to training activities on human rights for professionals in the penitentiary area.

The deputy rejected the change because she considered that the issue “depends on several referrals, among them, for example, demands regarding prison architecture, a situation that can be a major obstacle for federative entities that have not yet made great progress on this issue. ”.

“It is understood that any condition imposed on federal entities to receive a budget allocation from Funpen that does not require a reasonable time for implementation should not, at least at this moment, be included in the law, under penalty of causing damage to prisons that need access to funds,” he added.
