The Chamber of Deputies approved the Provisional Measure that cancels, until the end of this year, tax credits for companies that buy fuel for their own use from bus, airline and transport companies, for example. The text still needs to go through the Senate.
The rule also provides for a one-time levy of ICMS, the main state tax, on fuels, including imported ones, based on a fixed rate per volume sold. Text refers to the importation of diesel oil and its streams, biodiesel and liquefied petroleum gas, petroleum derivatives and natural gas, and aviation kerosene.
In the same opinion, the rapporteur, deputy Danilo Forte (União-CE), decided to increase the mandatory percentage of biodiesel added to diesel oil from 2023 and change the rules of the electricity sector.
The proposal brings a regime of public electric energy service concessions, to provide greater legal certainty and provide greater clarity to relevant concepts in the sector, according to the rapporteur.
According to the approved text, the concessions are in the establishment of tariffs for the use of transmission systems based on the following guidelines:
- Use of location signal methodology in the definition of tariffs, which must consider the national policy of expansion of the electricity matrix, aiming at reducing regional inequalities, maximum energy efficiency and the greatest environmental benefit, in compliance with the guidelines of the National Energy Policy Council and the regulation of the Executive Power;
- Definition of tariffs for the use of transmission systems for concessions at the time of grant, which will remain in effect throughout the concession period, and must be updated by the Transmission Update Index.
- Granting of an additional period of 24 months for the start-up of operations of generation projects from renewable sources that provide guarantees of faithful compliance compatible with the respective power of the generating complex and the date of start-up to be entitled to discounts on transmission and distribution tariffs .
“The publication of this MP is intended to increase legal certainty in the relations between the public administration and taxpayers, without causing a fiscal impact”, explained the General Secretariat of the Presidency of the Republic in a note.
