Chamber approves MP to facilitate insertion and return of women to work

The plenary of the Chamber of Deputies approved, this Tuesday (30), a Provisional Measure that seeks to facilitate the insertion of women in the labor market and their return after giving birth, especially through the institution of the Employs + Women program.

The text also makes the work regime more flexible in some situations. It states, for example, that employers should give priority to placing mothers and fathers with a child, stepchild or child under judicial custody up to six years of age or with a disability in a regime of telework, remote work and remote work.

The Provisional Measure brings actions to support early childhood parenting, such as the payment of daycare reimbursement and maintenance or subsidy for early childhood education institutions by social services. A point in the text allows employers who adopt the childcare reimbursement benefit to be released from the obligation to provide a nursery at the workplace.

In addition to teleworking, it also seeks to make the work regime more flexible to support parenthood through part-time work, a special workday compensation regime through hour banks, early individual vacations and entry and exit times. more flexible, for example.

The aforementioned measures must be formalized through an individual agreement, collective agreement or collective bargaining agreement.

The text also deals with incentives to support the return to work of mothers after the end of maternity leave, the qualification of women, the prevention and fight against sexual harassment in companies and microcredit. An excerpt adds the rule of wage parity between men and women who perform the same function within the same company.

The Provisional Measure also changes part of the rules of the Citizen Company Program. According to the text, companies can replace the period of extension of maternity leave by reducing the working day by 50% for a period of 120 days.

For this, it is necessary that there is full payment of the salary to the maid or employee for a period of 120 days, in addition to an individual agreement signed between the employer and the maid or employee.

The extension is also allowed to be shared between the employee and the applicant employee, provided that both are employees of a company that adheres to the program and that the decision is adopted jointly, following the regulation.

Other points in the text deal with the suspension of the employment contract of women for qualification in strategic areas and of parents to monitor the development of their children.

It also creates the Emprega + Mulher seal for companies with good practices in promoting the employability of women and expands amounts available for loans to women entrepreneurs and informal workers in the Digital Microcredit Simplification Program for Entrepreneurs (SIM Digital).

The rapporteur of the matter, Celina Leão (PP-DF), accepted a series of amendments proposed by colleagues. However, she took out the part dealing with minor apprentices. The text of the Provisional Measure modifies the current legislation and institutes the National Project of Incentive to the Hiring of Apprentices. She evaluated that the matter entered the scope of what was being discussed in a special committee of the Chamber that seeks to establish the Apprentice Statute, “not recognizing a good part of the legislative efforts made until then”.

“For all these reasons, we decided to delete the points of the Provisional Measure on learning from the PLV, leaving this content for discussion within the scope of the Special Committee of PL 6.461/2019”, he wrote in the opinion.

The initiative was supported by the opposition, but criticized by federal deputy Marcel Van Hattem (Novo-RS), for example. The Provisional Measure was approved with 395 votes in favor and 7 against.

The matter goes to the Senate for review.

This week, the Chamber and Senate are promoting the so-called “concentrated effort” of voting on Provisional Measures that expire until September in an attempt to not disturb parliamentarians in the midst of the election campaign. None of the plenary sessions held have mandatory physical presence.

Expansion of housing fund coverage goes to sanction

The Chamber and then the Senate approved this Tuesday a project derived from a Provisional Measure that expands the coverage of the Fund for Guaranteeing Popular Housing – FGHab. According to the text, among other points, the operations contracted under the Casa Verde e Amarela Program may be covered by the fund, under the terms of the legislation and its statute. Another novelty is that the text extends the coverage of the FGHab to used or existing properties.

The bill goes to presidential sanction.
