Chamber approves project that regulates home education; text goes to Senate

The plenary of the Chamber of Deputies approved, this Wednesday (18), the bill that regulates the practice of basic home education, known as homeschooling, in the country.

All nine suggestions for changes to the base text were rejected by federal deputies this Thursday (19).

Even lacking only highlights, the opposition tried to obstruct the vote following the Chamber’s bylaws, but there was no success.

Even the president of the Chamber, Arthur Lira, in the conduct of the session, threatened to close the session if there was not a minimum quorum of 257 parliamentarians to proceed with the voting of the day.

Lira also said that the session would have an administrative effect, if leaders of benches and deputies did not attend the plenary. This effect means that anyone who is absent from the plenary session on that day will receive a point discount.

“I need to warn the deputies that if none of the leaders register their presence, the session will fall. As of next week, with regard to the plenary on Thursdays, every Thursday will have administrative effect for the deputies. It will not go unpunished,” added Lira.

The project approved by federal deputies amends the law that establishes the guidelines and bases of national education to provide for the admission of home education, in addition to school education.

According to the project, basic home education is now admitted by free choice and under the responsibility of the students’ parents or legal guardians. Basic education comprises pre-school, elementary and secondary education.

The student must be enrolled annually and have the option for home education formalized, by the parents or guardians, with an educational institution accredited by the competent body of the education system that offers the modality.

The chosen educational institution must keep a record of the homeschooling students enrolled in it, which must be updated and informed every year to Organs competent bodies.

At the time of formalization for homeschooling, proof of higher education or technological professional education must be presented, in a recognized course, by at least one of the parents or legal guardians of the student or preceptor. The presentation of criminal certificates from the Federal and State or District Courts of the parents or guardians is also required.

The curricular contents referring to the student’s school year must be fulfilled in accordance with the National Curricular Common Base. The inclusion of relevant additional curricular contents will be allowed.

The National Board of Education will be responsible for editing the national guidelines. Education systems must adopt measures to ensure and enable the right of parents or legal guardians of the student to choose homeschooling and its practical application.
