Chamber prosecutor defends release of resources from Silveira’s parliamentary quota

The Prosecutor’s Office of the Chamber of Deputies manifested itself, this Thursday (9), against blocking the resources of the parliamentary quota destined for federal deputy Daniel Silveira (PTB-RJ).

In the opinion sent to the Federal Supreme Court (STF), the Chamber attorney, deputy Luís Tibé (Avante-MG), states that the decision of Minister Alexandre de Moraes, of the STF, to block any banking activity by Silveira affronts the independence of another Power and the exercise of the elective mandate.

“Constrictive judicial measures without relevance to the subjective ownership of CEAP [Cota para o Exercício da Atividade Parlamentar], which directly block refunded deposits in bank accounts indicated by parliamentarians, affect the free exercise of parliamentary activity and simultaneously violate the following principles of our Republic: i) popular representation; ii) the independence of the Legislative Power; and iii) the isonomy of federative entities,” he said.

Tibé argues that the decision makes the effective exercise of parliamentary activity unfeasible, since the quota resources are used to pay for services such as airline tickets.

“The fact is that the granting of constrictive judicial measures cannot harm the effectiveness of the CEAP – a sum that is essentially intended for a public purpose – unless it is a reason directly related to the creation, regulation and disposal of the budget itself. Otherwise, judicial constriction will immediately and inexorably result in blocking the exercise of the parliamentary mandate”, he argues.

On Wednesday (8), the defense of Daniel Silveira presented to the STF a request to unblock the bank account of the deputy’s wife, Paola Daniel, blocked by Minister Alexandre de Moraes.

The defense also asked to have access to the decision, which is confidential, saying it was “surprised” by the blockade.

Silveira’s wife is also a lawyer and works in the defense of the parliamentarian. On Twitter, Paola said that all the money she had in the account is gone. “Urgent! Alexandre de Moraes blocks my account, kidnaps all the money in it, without a warrant, and I am a lawyer in the process. This is unacceptable and extremely illegal. I just can’t believe it!” she stated.
