For judge Gabriella Ratti, of the First Civil Section of the Court of Turin, who accepted the appeal presented by some consumer associations, in the advertising campaign there was an intent to deceive the public.
A «unfair commercial practice», which violates the Consumer Code. According to the advertising, in fact, the sale of the product, which had a higher price than the standards of a classic product in the same range, would have involved a donation to the Regina Margherita Hospital in Turin. In reality, however, the proceeds from the sales ended up in the pockets of Ferragni and the confectionery company, linked by a commercial agreement that already established an amount to be allocated to the Piedmontese hospital.
A “very important sentence”, Codacons announces, «which on the one hand opens the way to compensation for all consumers who had purchased the pandoro in question, on the other it worsens the position of Chiara Ferragni in the investigation for aggravated fraud conducted by the Milan Prosecutor's Office». Balocco, in a note, specified that «The Civil Court of Turin rejected the request of some consumer associations (Codacons, Adusbef and Assourt) to pay one million and 500 thousand euros as compensation for the damage as part of the operation Pink Christmas.” The confectionery company will appeal against this ruling, while no response has been received from Chiara Ferragni.
