The City of São Paulo went to court against Enel, so that the distributor could immediately restore energy to missing points in the city.
The petition sent to the 2nd Public Finance Court also asks that the company be fined R$200,000 per day if it does not comply with the determination.
This Tuesday morning (15), 250 thousand customers were still without power in the Metropolitan Region of São Paulo.
Capital states in the petition that Enel persists in “chronic non-compliance” with the 2023 Annual Pruning Plan.
The administration of Mayor Ricardo Nunes (MDB) also states that the Federal Government did not present a contingency plan “with the dimensions and peculiarities of the municipality of São Paulo”.
According to City Hall, this plan should take into account the number of trees in contact with electrical wiring or on public roads, in addition to the high probability of weather events, which occur in the city every year, between the months of October and March.
The City Hall points out that it contacted the Electric Energy Regulatory Agency (Aneel) and the Federal Audit Court (TCU) about the “deficiencies in the public service provided by Enel”, as mentioned in the petition.
In the request, the administration emphasizes that the distributor must carry out branch pruning on more than 225 thousand trees in the capital of São Paulo, “without depending on any authorization from the City Hall”.
This prerogative is provided for in the 2022 Agreement for Tree Management in the City of São Paulo. The City Hall also states that Enel “demonstrates blatant inefficiency in facing extreme weather conditions”.
The judge responsible for the case, Erika Folhadella Costa, has not yet decided on the request.
