The Civil Police of Rio de Janeiro are investigating a day care center and relatives of Kenya Gabriela Oliveira, 2 years old, on suspicion of omission.
A CNN the delegate Márcia Helena Julião, from the 43rd DP (Guaratiba), stated that the child’s mother has already been heard and that the director of the day care center where the child was enrolled should give a statement this Monday (13).
According to investigations, there are indications that the school unit and close relatives in Kenya knew that the girl was the victim of abuse and did not report the case to the Tutelary Council.
All are investigated by article 26 of Law 14.344/22 (Henry Borel Law), which says that “it makes a crime the conduct of not communicating to public authorities the practice of violence, cruel or degrading treatment or violent forms of education, correction or discipline against children or adolescents, as well as cases of abandonment of the incapable”.
Last Saturday (11), judge Daniele Lima Pires Barbosa converted the arrest in flagrante delicto to preventive arrest (for an indefinite period) of Marcos Vinicius Lino de Lima and Patrícia André Ribeiro, indicted for the death of Kenya Gabriela Oliveira Matos de Lima, on 2 years.
In the decision, the magistrate cited that both demonstrated sadistic and vile behavior against a young child.
According to investigations by the 43rd DP, the girl’s father and stepmother are suspected of mistreatment that resulted in the child’s death, after the autopsy report identified about 60 injuries on the victim’s body, most of which are compatible with torture.
The case was discovered last Thursday (09), after the child was taken, lifeless, to a Family Clinic in Guaratiba, West Zone of Rio. At first, the father and stepmother would have said that the girl had fallen and lost consciousness.
However, when trying to revive Kenya, the doctor Ana Cláudia Regert found several injuries compatible with physical aggression and reported the case to the Civil Police.
On the morning of this Monday (13), the production of CNN found that Marcos Vinícius de Lima and Patrícia André Ribeiro are in isolated cells from the other prisoners for “security reasons”, according to the Secretariat of Penitentiary Administration (Seap).
A CNN was unable to contact the defense of the accused.
